IRCC Updates Intra-Company Transferee Rules under CETA and CUKTCA – May 2025

Canada’s Immigration, Refugees and Citizenship Canada (IRCC) has released a major program delivery update for intra-company transferees (ICTs) under the Canada-European Union Comprehensive Economic and Trade Agreement (CETA) and the Canada-United Kingdom Trade Continuity Agreement (CUKTCA).

This update clarifies eligibility requirements, corrects the length of stay details, and removes the word "senior" from the manager role definition, allowing more flexibility for international talent movement.

Key Highlights of the May 2025 ICT Update

  • Correction to Length of Stay rules for executive, trainee, and specialized knowledge workers.
  • The word "senior" has been removed from manager-level roles under CETA and CUKTCA.
  • Updated documentary requirements and clarified application process.
  • Reinforced rules on job title accuracy, experience requirements, and employer relationships.
  • Expanded guidance on refusals, allowable durations, and work permit conditions.

  • Inadequate evidence of specialized knowledge or executive authority
  • A mismatch between the foreign and Canadian roles
  • The employer is not actively doing business in Canada

Switching ICT Categories: What You Should Know

Applicants can switch from one ICT category to another (e.g., from trainee to manager) if they meet experience requirements, and have not exceeded the 4.5-year maximum duration.

⛔ However, time spent under one ICT category counts toward the total allowable stay under another.

  • Should be transferred for career development or training
  • No extensions are permitted

Specialized Knowledge Workers – What Qualifies?

To qualify, applicants must prove both:

  1. Advanced proprietary knowledge of products, services, or processes.
  2. Advanced level of expertise gained through significant and recent experience.

Officers assess:

  • Whether this knowledge is rare within the industry and company
  • How critical the applicant is to the Canadian business
  • Whether their expertise could be easily transferred to another employee

Executives & Managers – What Counts?

Executives (TEER 0) must:

  • Direct the management of the business or a major function
  • Set company policies and goals
  • Exercise wide discretionary power

Managers (TEER 1) must:

  • Supervise departments or key functions
  • Manage staff or essential business operations
  • Have authority over hiring, promotion, and performance decisions

Spouses and Common-Law Partners

Under exemption code T45, spouses or common-law partners of EU ICTs are eligible for open work permits valid for the same period as the principal applicant’s work permit.
