Canada’s Immigration, Refugees and Citizenship Canada (IRCC) and Canada Border Services Agency (CBSA) have adopted new, standardized procedures for returning appeal-allowed family class sponsorship files for redetermination after success at the Immigration Appeal Division (IAD) as of November 26, 2025. This operational update clarifies the handoff and digitization process, aiming to reduce post-appeal delays, improve consistency between agencies, and ensure sponsors get timely decisions once their appeal is allowed.​

New Workflow for Appeal-Allowed Family Class Files

The new IRCC/CBSA instructions affect sponsors who win appeals of family class sponsorship refusals at the IAD. Rather than funneling all cases through one central location, as of May 13, 2024, files are sent directly back to the original IRCC office that made the first decision for fresh redetermination. This speeds up the review and avoids further delay for affected families.​

Key process changes include:

  • After an appeal is allowed, CBSA updates the Global Case Management System (GCMS) with the IAD decision and supporting documents, and notifies the IRCC office responsible for the original decision.
  • If the appeal file is fully digitized (all documents in GCMS), an email triggers the redetermination at the local IRCC office.
  • Where paper documents remain, CBSA sends them to the New Waterford Digitization Centre (NWDC) and notifies both NWDC and the original IRCC office. Once digitized, NWDC alerts IRCC and the file is eligible for redetermination.​
  • No substantive eligibility rules are changed; redetermination must still comply with IAD’s decision and all other legal requirements.

Sponsors who win at the IAD will now see clearer workflows, less confusion, and the promise of faster processing for reopened applications.
